NEED HELP REGARDS FLR(M) DIVORCED DURING APPLICATION

HI, I NEED IMMEDIATE HELP. I MARRIED WITH A BRITISH NATIONAL END OF LAST YEAR AND SUBMITTED MY FLR(M) APPLICATION RIGHT AFTER THAT. MY WIFE SEPERATED FROM ME, NOT DIVORCED , AFTER 8 MONTHS OF OUR WEDDING WHILE MY APPLICATION WAS STILL IN PROGRESS. SHE LEFT ME AND ALSO INFORMED UKBA THAT WE ARE DIVORCED BUT THE TRUTH IS WE ARE NOT DIVORCED. WE ARE JUST SEPERATED. FEW DAYS AFTER SHE INFORMED HOME OFFICE MY APPLICATION WAS REJECTED ON THE BASIS THAT WE ARE DIVORCED, HOWEVER NO DIVORCE APPLICATION HAS BEEN FILED YET. I CONTACTED ONE LOCAL SOLICITOR. WE APPEALED FOR IT. MY COURT HEARING IS MARCH NEXT YEAR.

MY VISA IS ALREADY EXPIRED AND I AM WAITING FOR HEARING.
MY QUESTION IS, IS THERE ANY POSSIBILITY OR SOLUTION FOR THIS SITUATION? MY SOLICITOR IS NOT VERY COOPERATIVE. DON'T KNOW WHAT TO DO.

Do not write in capitals please.

You don't need to be divorced, if the relationship has ended, nothing you can do, it's over, no subsisting marriage. Unless you have children, your chances to remain are slim.

it's shame that British immigration law is so harsh. under EU law family members rights are protected even if separated not divorced.

is it domestic violence ?

don't you think that person can switch to other UK immigration routes ?

Domestic law is more restrictive yes, the OP may be able to make another application, unlikely an In-Country and this may break the lawful residence for a long residence application, if the appeal fails.
