Hi

This forum is so helpful.
I am applying for ILR and I have to fill in SET(O). I have one question

Can you please tell what can be the correct answer to this question in the form.
7.11 How long have you lived in the UK?

Oct 2006 - Sep 2008 (1 year 10 months on Working holiday maker - Not accepted for ILR)
Feb 2009 - Jan 2014 (4 years 11 months 7 days on Work permit + Tier 2 - Accepted for ILR)

For the question 7.11 in SET(O) form. Do I need to add the time which is not counted in the ILR qualifying period?

Please advise.

Are you suggesting to mention only the qualifying period for ILR which is
Feb 2009 - Jan 2014 (4 years 11 months 7 days on Work permit + Tier 2 - Accepted for ILR)

Feb 2009 as the question asks:
When did you (the main applicant) first enter the UK? This
refers to the date of your first entry into the UK at the beginning
of the period of stay on which this application is based.

Hello,

Please I have a related question. I switched in country (in the UK) from a student visa to work permit and then to Tier 1. I am applying for ILR based on work permit + Tier 1. If the question in 7.11 is when did I start living in the UK - shouldn't this include my time as a student as that was when I moved to the UK (I haven't left since).

Thanks for your reply. No, my application is not based on my time as a student - I see the point you allude to. It should be my time in the qualifying/relevant category.

Hi

I have mentioned only the qualifying time for ILR in question 7.11 and my application is approved on the same day of appointment.
So, I think for ILR applicants you need to mention the time which is applicable for ILR not your other stays on different visas.

7.11 is asking about "How long have you lived in UK" in very clear and unambiguous words, so it will include time spent in other leave categories as well

6.1 is asking about the ILR qualifying period so common sense says no point in repeating the same info again

Fact that you got your ILR means CWs ignore minor mistakes on the form

Couple of my friends on Tier 1 got ILR. They were both entered UK after couple of months of getting first EC ( 90 days rule ). They also applied couple of weeks before the qualifying period ends i.e. 28 days rule. So in short they both were in UK for 4 years and 9 months. One of them wrote 4 years and 11 months and the other wrote 5 years. They both got ILR.

I have a difficulty in filling correct information.

Visa Granted : 1st April 2009
Date of Entry : 25th May 2009

Do i calculate period from 1st Apr or 25th May?

You have to count from 1st Apr.

28 days before 1st April 2014 you would have been eligible to apply. So basically you could have applied in March 2014.

You can apply anytime now before current visa expiry

In terms of calculating period spent in UK it will be from 25th May.

Hi guys! A related question. I am on Tier 1, will apply for settlement soon. My Tier was obtained in June 2009. I was away from the Uk due to health complications for 199 days (6 months and a couple of weeks) (all during paid leave - maternity+annual leave). Departed on 29.01.2010 and returned on 17.08.2010. When answering the question "How long have you lived in the UK" in Set O, do I deduct 6 or 7 months from the qualifying 5 years period? In addition in late 2010, I went for 88 days abroad (during maternity leave) again. Should I discount these 3 months too as not living in the UK, So its 4 years and 2.5 months that I spent in the UK? Thank you!

Hello,

I came to UK in August 2004 on student Visa, Got IGS Visa in Dec 2007 and TIER 1 (General) inJune 2008.

I need to calculate my time from Aug 2004 or June 2008.

Though it seems very stupid question but I am confused. I am going to PEO next week for ILR.
