applied dec 1st week 2012 (team application)
bio dec 3rd week 2012
interview date 4 june @shiffield
refused june 2013
hearing 25 jan 2013
my refusual points.
1. There high concerns regarding the evidence that has been submited with your application and at interview.
2.you have not satisfactorily demonstrated that you are a genuine entreprenur as set out at paragaraph245dd(h)and when assesing on the balance of probabilites the points liste at paragraph 245dd(i) of the immigration rules.



My barrister raised the point to Judge and Home office rep that how come the new rules applied to these appellants,my barrister provided sufficient information to judge, that the decision has to be given by the old rules( before 31st jan 2013),home office rep and judge agreed to the point raised by my barrister.judge allowed my appeal and said to me i am allowing your appeal and write a letter to home office to reconsider the judgement according to the old rules.


I need expert advice pls

I would really appreciate your comments.

It simply means that the HO will look into your application again in line of the immigration rules in practice at the time of your application. I don't get that the IJ asked you to write a letter to HO for reconsideration of your case. I believe the determination will be self-explanatory in this regard following by the minutes/comments of the HOPO for a HO case worker.Anyway,to put your mind at ease, discuss with your lawyer whether you need to write a letter to HO in this regard or not as your lawyer is well-observer of your circumstances.

Normally How many days take ???

Any one got same problem ???

It's all depends how busy judge is, but around 4 weeks after hearing but some people received in 4 days after their hearing.

@ harry153, you will need to wait for the judge decision in writing before you can do anything.

Harry usually they take up to 4 to 6 weeks. So its better to wait, If nothing comes on in next 2 weeks tell your barrister or solicitor to send them a reminder.
