Employment for Dependent of EEA National

Hello Gurus & Forum Members,

I have recently got Tier-1 Entrepreneur visa switching from PSW. Now I am going to employ one full time worker for the purpose of my tier-1 entrepreneur visa extension.

As per policy guidance, we need to employ worker who is settled in the UK.

My question is Can I employ partner of EEA national who has got residence card to live in UK valid for 5 years on basis of partner excersing treaty rights in the UK??

Can this employee be considered as settled worker in the United Kingdom.

I have read couple of reports regarding this and I can confirm that the business can employ indefinate leave to remain visa holders, british nationals and european nationals. But I am not sure about dependent of EEA National with 5 years residence card.

Could you please comment on this??

@ muhammadaliabad, dependant of EEA national are visa holders and cant be use to get point for employment creation during extension.
Settled people are those with ILR.

But you can employ the individual if you so wish but you cant use them for the purpose of extension.
