OCI on the basis of wife

Post by keepsim » Thu May 01, 2014 10:36 am

I've a query for somebody else would appreciate any advice on OCI.

The Person is a British Citizen and around 60 years old, never had an Indian Passport himself basically born in Kenya (indian decent) and came over to the UK. His wife in the UK is still an Indian Passport (PR) so the query -

Will his Wife Indian passport enough to get his OCI ?

if OCI is not possible option for him then how about PIO ?

OCI not possible through spouse, PIO is possible.

However as he is indian descent, he may be eligible for OCI through parents or grandparents' route.

ban.s is correct :).
Just for the sake of reference, please check question 4 at http://mha1.nic.in/pdfs/oci-faq.pdf

4.Can the spouse of the eligible person apply for OCI?
Yes, if he/she is eligible in his/her own capacity.
