Spouse on ILR can leave UK

Post by Naqwi » Sun Jun 15, 2014 7:51 pm

Hello Expert,
my spouse is on ILR visa, she would like to go outside UK for 6 months to complete House Job (Doctor).
can she stay outside the UK more than 90 days?
does that stay effect her ILR / naturalization?

i look forward to hear from you.

Regards
Naqwi

Yes she can stay out for more than 90 days. She will then have to wait till she returns to make sure her absence is within 90 days before she can apply for citizenship, unless she asks for discretion on absences.

6 months will not affect her ILR.

Absences should be limited and for good reason. Keep proof of a subsisting relationship during absence periods.

Amber, as she already has ILR absence can be up to 2 years without this being affected and proof of a subsisting relationship isn't necessary for a BC application. As CR001 has advised, there should be no more than 90 days absence in the 12 months before an application for BC.

Thanks Casa. Sorry, I read it as 'spouse of ILR visa' as in spouse of a person with ILR. In such case what CR001 has stated is correct.

Indeed, although my other half isn't too happy tonight as Spain lost. He was supporting them as he'd lost hope in England. However, he's now switched back to England. Can't keep up :D
