ILR Visa Application 2014 August

Post by discovery2012 » Sun Aug 17, 2014 2:09 pm

Hi,
I have got Tier 1 (General) visa in august 2009 and in August 2014 my continuous 5 years will be complete. I have married in November 2011 and my wife is under PBS (Tier 1 (General)) dependent visa. I have a 11 months old child and do not have any visa at the moment. Now I want to apply for indefinite leave to remain visa. I want to apply for ILR with two dependants (my wife and my child). So here are my questions please answer them if you know.

1. Do I have to show maintenance fund for me, for my wife or for my child, if yes how much amount?
2. I have learned that I need SET(O) form for myself, if answer is no, what visa form do I need?
3.a. Could you please mention application form for me, for my wife and for my child?
3.b. Do I just need one SET(O) application form?
4.a. I took a loan £8,000 3 years ago and I am paying regularly monthly instalment. After 3 years the loan balance now stand is £3,500. I have spent about £1,000 from my credit as well. I do not have any unpaid history. So, will this be a problem to get ILR visa?
4.b. I want to apply in person so, should I be prepared to explain this spending?

Thank you in advance.

If the child was born in the UK, the child does not need to apply for ILR, rather can register as British as soon as either parent is settled: s1(3) BNA 1981.

1. No.
2. SET(O) is correct.
3. One application.
4. No for both.

Hi, please could you advise what is the situation with a child who has arrived in UK (on Tier 1 dependant visa) just a month before her father applies for ILR. Mother is also on tier 1 dependant visa.

Can the child get ILR straightaway with father or does she have to spend 5 years in line with her mother.

Hi, Amber thank you for your quick and clear reply. So, should I follow the following steps:
1. Apply for ILR with one SET(O) application for me & my wife (as dependent).
2.a. Apply to register my child as British citizen using FORM MN1 after getting ILR
2.b. Apply for child' British Passport after register child as British citizen

Thank you again. Take care

Hi amber, could u please help? I am applying for ilr, my income source for first 5 month was salaried and rest 7 month as limited company. I am not sure what do write under section earnings. Is it average ie, sum of all salaries /12? Or just average of earning from limited company of which am 100% shareholder?

Please help... I been asking I every forum... No one is answering.
