ILR Interview

Hi All,

New immigration rules are announced today, among various changes there is a new paragraph 39C which gives the caseworker power to ask ILR applicants to attend an interview!

It said all ILR applications:

“Indefinite leave to enter or remain”
39C (a)
An applicant for indefinite leave to enter or remain
must, unless the
applicant provides a reasonable explanati
on, comply with any request made by
the Secretary of State to
attend an interview.
(b)
If the decision-maker
has reasonable cause to
doubt (on examination or
interview or on any other basis) that
any document submitted by an applicant
for the purposes of satisfying the requirements of Appendix KoLL of these
Rules was genuinely obtained, that
document may be discounted for the
purposes of the application.
(c)
Where sub-paragraph (b) applies,
the decision-maker may request the
applicant to provide additional evidence
of knowledge of the English language
and/or knowledge about life in the UK (as
set out in paragraphs 3.2(b)(ii) and
3.3
of Appendix KoLL) for the purposes of demonstrating sufficient
knowledge of the English language re
quirement and sufficient knowledge
about life in the United Kingdom
in accordance with Appendix KoLL.
(d)
A decision-maker will not request evidence under sub-paragraph (c) where
the decision-maker does not anticipate
that the supply of that evidence will
lead to a grant of leave to enter or
remain in the United Kingdom because the
application may be refused for other reasons.

It's always been the case that if the case worker isn't satisfied with the application the applicant can be required to attend an interview. This doesn't mean that all ILR applicants will be interviewed, which your post suggests.

I agree with Casa. From members past experiences only the applicants with English language certificate from suspicion test center or the applicants who applying for their partners applications having unclear cohabitation record were invited for interviews.

i read it carefully, I know that they have interviewed the applicants but the fact that they made a new section in the rules specifically for ILR application and insisted on the interview does not seem very nice. Usually these changes come with more hassle and restrictions. The same thing happened for Tier 1 G applicants. Anyway, I wish you are right on this issue.

Hi,
I guess they have made a new section in it cause may be there are many cases of fake English tests coming up,so they want to address that issue.
But the major grey area is the 180 day allowance for tier 1 general ,tht does not specify if unemployed absences are ok,with ext closing this is really disgusting whether to take a risk by directly applying ILR or again go for 2nd ext be4 it closes and get ripped off cause of the fees.
No one gives the right picture ,I tried asking some1 from ukba,but no reply and on this forum all give all different answers .its really frustrating

Yeah I am in similar situation. Their guidance is too vague and unclear and the fact that they apply a rules to the dates before the rules is wired. The good news is that they have not closed Appeal for ILR and Tier 1 applications yet.

Hi Sam,
When did you applied for your ILR? Are you self employment? Any amendments done for previous tax years?then they would ask regarding that .
