ILR apply up to 28 days before 5 years completion

Post by t1guk » Wed Dec 24, 2014 3:28 pm

Hi there!
I am on Tier-1(General) soon to be eligible for ILR.

Visa Granted: September 2009
First Entry : February 2010, 1st week
More than 120 days between grant of visa and first entry.

While in the UK, 70 days absence in 5 years visiting family and friends.

From the threads on this forum, I'm eligible for January application i.e. can apply up to 28 days before 5 years stay completion. I'm looking for official documentation that confirms the same, but can't seem to find it. AFAICT the continuous period PDF document
doesn't have this. Can someone point me in the right direction? I'm aiming for a PEO application.

Also, does my absence of 70 days visiting family and friends affect a January application? I could play it safe and apply in February second week or so.

Happy Holidays and a Happy and Safe New Year 2015 to all! Thanks!

Absences should not be more than 180 days per 12 month cycle.

Perfect, thank you very much.

I was looking for something in the immigration rules etc. But it's in the form!

My maximum period of absence for a single trip from the UK is around 50 days and I plan to put in a letter + dig up the flight itinerary and attach it to the letter.

Thanks!
