Family Visa

Post by qaws_14 » Wed Dec 31, 2014 10:39 pm

Dear All,

First of all Thanks to the forum and the members who provide a very good information when required the most.

I am confused about the finance aspect to bring my son here to the UK from India.

We (Daughter of age 07, wife and myself are British citizens) and my son who is 11 now is on India passport and his dependant visa has expired long ago.

He is in India and has not been to the UK for roughly 07 years or more.

I want to bring him here to join the family as we miss him a lot (naturally). But the finance rules are not clear to me. Someone please help.

Appendix FM point 2.4 says, I need 24800 as salary whereas this link below
http://www.immigrationboards.com/immigr ... 04025.html
says that I need 263.81 left over per week after rent and council tax. Currently I do not have this left over, but my salary is over the limit.

I do not know what to do.

Only thing I think is I need to apply for Indefinite Leave to Enter for my son.

Please guide.

I believe that adequate maintenance is required.

If your salary is over the Appendix FM's limit, then it's hard to imagine that it's not adequate.

Dear Vinny,

Thank you for the reply.

The puzzle is that my salary is 27000+ which is over the limit of couple with two kids i.e. 24800 as per the Appendix FM point 2.4.

But when I look at the weekly left over of 263.81 for adequate maintenance, I cannot meet that currently or even in near future.

So is the question, what to do ? This is a confusion.
And just to let you know that I do not claim any benefits, whatsoever.

My son's application keeps on pushed back just because of reason like this and I could not apply.

Please guide.

Thank you once again.

It may help if you can give a breakdown of your calculations.

Thank you Vinny,

The breakdown is as follows :
Monthly salary before tax and NI and Pension 2250.00
Yearly salary 27250.00

Monthly rent for accommodation (private) 675.00
council tax 110.00
Rent includes bills like water, electricity and gas.

Other bills like telephone, broadband, TV etc 100.00 per month

Salary paid after tax and NI and Pension 1670.00

cash left after rent and council tax 885.00 (1670 - 675 - 110)

This is way below what I should have as per the below link

http://www.immigrationboards.com/immigr ... 85667.html

I quote from that post as below

***** Start of quote
e.g. using these calculations a couple with two children would need to show:

£114.85 for couple
£17.45 family premium
£66.90 x 2 (£66.90 for each dependant child)

=£266.10 per week/£1153.10 per calendar month left over after deducting rent/mortgage and council tax.

***** End of quote

Please guide
