Hello Everyone,

Appreciated this has been asked several times in the past, I just wanted to confirm the process before submitting the forms. Seems like the process keeps changing over time. Is the below accurate?

We have a child (under 12 months old) who was born in the UK. We both hold EU passports. We have both lived and worked in the UK since 2005. We do not hold any EEA Resident Cards however reside permanently in the UK. We can provide evidence (bank statements, P60's etc) to support the application. Is there a suggested list of evidence?

From the UK Citizenship website, our child appears to qualify - we interpret legally settled to mean exercising EU rights to live/work in the UK:

"Child born in the UK to 'legally settled' citizens automatically attains UK citizenship. Provide this evidence when applying for child's first passport."
We will apply online for our child's first passport via the Gov UK website - as per their instructions here:

You don't apply for passport online, just fill in the form online, you then need to print it (or they send it to you), sign it and send it in the post with supporting documents.

You child would be British from birth if born in the UK and one of parent was settled. To be settled under EEA Regulations means exercising treaty rights for continuous 5 years (working for 5 continuous year for example. If you are from one of the 2004 joiners to the EU, you had to register under WRS first to qualify). Evidence proving your 5 years treaty rights is required to support the application.
