HI Everyone,

I'm just checking if my wife is eligible for ILR.

She came to UK in March 2011 on tier 1 dependent

Lived in UK March-2011 till May 2012 (14 months)
India May 2012 - June 2012 (2 month)
UK June 2012 - September 2012 (3 months)
India - September 2012 till July 2013 (10 months)
UK - July 2013 - Till date (19 months)

Total in UK - 36 months
Total in INdia - 12 months

Please help if i can apply ILR for her.

Can someone reply please .

So she is in UK for total of around 3 years on Tier 1 dependent . But she was not here continuously for 2 years (maximim continuity is for 17 months). Is 2 years continuity important ?

Or is it OK with minimum 2 years even its not continuous stay?
Can she apply for ILR?

It's 5 years on PBS or PBS dep. unless married to a BC/ILR holder....

I have read if she is on PBS dependent and arrived in UK before 2012 then she is eligible for ILR for 2 years stay in UK.
So just wanted to know if it should be continuous or 2 years anytime ?

Pretty sure that's only if the main visa holder has gained ILR at least subject to some rules I've not researched, there's no way a dep. could get without the main visa holder being ILR/BC, doesn't make sense otherwise....

Hi guys we are a group of people whose families were effected by the pre july rules that were changed in april 2014. which made it impossible for families to apply for 2 years rather 5 years visa.anyone wants to join us to challenge this rule in high court should come forward and can contact me on my number :07983572444.
