I need urgent help. It would be great if anyone give me genuine advice.

My tier 1 entrepreneur visa was refused at the court. The time frame was as follow:

Applied in January 2014 (Single applicant from PSW route)
Interviewed on: March 2014
Refused on: April 2014 ( Case worker suspected that the money was not mine though I had £50000 in my account. He also claimed that I had no experience to run the business)
Appealed to the FTT on: April 2014
Appeal hearing on: 16/01/2015
FTT Judge din not allow the appeal on: 29/01/2015 ( Judge explained that I could provide bank statements for last 4 years to show that I saved the money though I submitted my proof of income as the form of P60 and pay slips.)
Applied to the FTT for leave to appeal at UTT on: 13/02/2015
Now waiting for their decision.

I am now trying to switch to Tier 4 visa category but the Universities or Colleges refused to offer me any CAS letter as I do not have any valid live to remain. I studied only one year as a Tier 4 student.

Would anyone please advise me what would be my best option. I have lived in the UK for nearly 8 years. My wife is living with me and I have son of 17 months. Universities asked me go back to my country (Bangladesh) and to apply from there. Should I do that? Most of the people are claiming that if I leave the country, they would not let me come again and my 10 years long stay would be broken.

Has anyone got visa from Bangladesh in this situation?

what course u studied before and on what visa u spent 8 yrs ?

Keep on trying for admission ......u wuld find one eventually

universities will most probably not give you CAS while your case is not decided.

but there is no harm in trying anyway...

I came to the UK in 2007 and I had 40 months visa. Eventually, I just did some diploma courses from June 2007 to Sept 2010 and then I studied MA TESOL from Sept 2010 to Sept 2011 at the University of Westminster. Then I applied for PSW and I applied for Tier 1 Entrepreneur visa before the PSW visa expired.

Dear Greenie,

I was a silent viewer of this forum for a long time and I noticed that you always provide accurate information that helps a lot. It would be great help if you could advise me on this mater.

I need to know if the UTT does not accept my leave to appeal can I apply directly to the Court of appeal and will my 10 years long residency be broken?

If the FTT refuse to allow your permission to appeal then you can renew your application to the Upper Tribunal directly. If this application is also refused your 3c leave will end at that point and you won't have any further right of appeal. Your continuous residence will not be broken if you make a successful application for leave to remain within 28 days of your 3c leave ending. However note that any application for further leave you make will be out of time and therefore you will be an overstayer with no right to work unless and until your application is granted.

I am really satisfied with the answers I got from this forum. It will be a great help for me if someone is able to help me in the following situation:

I have got an offer from a university to study PHD but the course will from 1st of October but I shall apply to the UTT for leave to appeal with in this week as FTT refused my leave to appeal, so it seems that this case will not continue till September that is the earliest time I can apply for student visa.

Now my concern is:

The university runs an English language course from 14th July, can I apply for that?
I have wife and a kid, will they be eligible to apply for visa if I apply for English course?
Or do I have any other option?

I received the decision from the FTT on 30/03/2015 and the judge mentioned that I applied out of time but that was not right. The FTT judge made the decision on 29/01/2015 but I received the letter on 02/02/2015, so my 14 days should start from 03/02/2015 and I applied on 13/02/2015. The FTT judge has given me permission to apply to apply directly within 14 days.

Can anyone help me please with the following questions:
Have I already been overstayer as they mentioned that I didnt apply within time limit?
Should I apply to the FTT again to reconsider?
