NON-eea qualifying time plus absence HELP PLEASE

Post by UKvsBRA » Sun May 24, 2015 4:18 pm

Hi there i really appreciate some help on this following questions...???

First Question?
I married EEA from Italy on 14 july of 2011; been leaving together since we married, she is working in UK as waiter and me registered and paying taxs as Self-Employed and our relation wasn't going well then we decide for divorce as she has another person now. We got our divorce certificate done last week. I'm very worrying if i Can apply to remain in UK on my own and retain my residence card? Also when i can apply to Permanent Residence (PR)? (if yes)..

Second Question… Absence???

As i get married in 14 of july 2011 i have been issue if my residence card in 13 of june 2012.
so my ABSENCE from uk was the following
28 dez 2012 to 11 april 2013
10 of may 2013 to 15 of 2014
but been paying taxs for all gaps and wife was here working as well…
So, my question is, it will be affect my Permanent Residence application?

Third question

Any one can help me how to count my qualifying years, for PR, since my married date which was 14/07/11?

Any advise pls?

Obie replied to your ex husband in his post as follows :

Obie wrote:The 330 days absence is very significant, and will cause significant difficulties if you wish to secure Permanent Residence.
If you are already divorced, you ex partner should be looking at possibly applying to retain his rights of residence.

Obie advised the following to your ex previously.
Obie wrote:14-07-2016 is the earliest time you can apply for Confirmation of a right of Permanent Residence.

You may be able to retain your right of residence, if a genuine marriage had lasted at least 3 years and that 1 of those years were spent in the UK, and she was a qualified person at the time of divorce.

On its face, you may be able to apply for confirmation of a retained right of residence.
