Subject to IHS if married to UK citizen?

Hi

I am currently on a Tier 2 general visa and am looking to get married to my spouse in November, I intend to switch to Spouse visa (FLR- M) via premium processing soon after, as mentioned in the heading, she is a UK citizen and is not subject to immigration rules. While filling the premium processing application. I have been redirected to a page where I will have to pay a fee of £500 towards IHS. (I am guessing it has calculated £200 *2.5 years).

My question though is, wouldnt i be exempt as per below picked from website?

When you don’t have to pay or get an IHS reference number

- You don’t need to get an IHS reference number or pay the healthcare surcharge if:

- you’re a family member of a European national with European Union treaty rights

Family members of EEA citizens


You can apply as a direct family member if you’re related to the EEA national as:

their spouse or civil partner

I called UKBA to enquire about this but did not find it very helpful.

Would appreciate some clarification on this matter

For immigration purposes your prospective spouse is not an EU citizen so UK rules apply and you need to pay the IHS.

Hello everyone.
I am going to pay for the immigration health surcharge and this is one of the questions.
Are you applying to join or remain with a person already in the UK?
Add the person?
My partner has the ILR, so should I add it or not please?
