Looking at the good character guidance and I am confused what is the correct Rehabilitation period for Conditional caution.
Simon was charged for resisting arrest in August 2015 and was on bail to appear in court however he agreed to the conditional caution
i.e. 2 conditions..
- Write an apology letter to the officer &
pay £50 fine.
Now he wants to apply for british citizenship however confused about Rehabilitation period for Conditional caution.
In AN guidance under Good Character Table LINE 4 it says..
then it says on the bottom to refer to this guide also.4. A non-custodial offence or
other out of court disposal that
is recorded on a person’s
criminal record
Application will normally be refused if the
conviction occurred in the last 3 years.
https://www.gov.uk/government/uploads/s ... ersion.pdf
on page 30 it says
andFines 5 years (or 2½ years if under 18 at the
time of conviction).
Could any please clarify this.Conditional caution Three months
Thank you
