PBS Dependent visa extension for British Citizen dependent

PBS Dependent visa extension for British Citizen dependent

Hello All

I am Naturalized British Citizen. My wife and daughter are in PBS Tier 1 Dependent Visa.

Their visa is due for extension.

Now I am not sure if I can still apply extension as PBS dependent.

They are eligible for ILR next Sept 2017. I knew that I can apply FLR visa for them, but their eligible to apply for ILR will reset if the visa category change from PBS dependent to FLR visa category.

Please advice.

If you got ILR based on the PBS route and 5 years residence, your dependents can continue to extend their existing visas until they meet the requirements for ILR.

DO NOT apply on FLR(M), this will reset their ILR qualifying clock to zero and a brand new 5 year residence requirement and they will lose the time spent as PBS dependents.

Can you not apply for ILR for your child if you have become a citizen? instead applying for a PBS dependant?

If the child's visa was issued at the same time or in line with the other parent, the child will follow the same route and qualify for ILR when the other parent does.

The child was born abroad.

I got my ILR yesterday.

I am thinking of extending my wife visa as a PBS dependant so that she qualifies for ILR in 2018 ( five yr route)

I am thinking of applying FLR(M) for son and apply ILR when i get my Citizenship (next year hopefully). just beacsue its a bit cheaper. i thought you can apply ILR to your children if one parent is a British Citizen.

Looks like my second option is wrong and i need to apply for PBS dependant even for my son.

Please confirm.

That's correct. Son cannot apply for FLR(M) on his own.
