Urgent! Went on Premium Service!

Dear Admin and all,

I went on premium service yesterday to vary my application from Tier 1 Entrepreneur Extension (applied in Nov,2016) to ILR LR. On my way to there I got a phone call saying that there is a fire evacuation and your appointment has been cancelled and we can reschedule you for next week. While she was doing that I mentioned that I wanted to vary my application as my previous application is in pending. She was bit confused then told me you cannot vary at premium because your leave has expired last month. You can post it but not vary. I mentioned that according to HO guideline I can vary at anytime until my decision is in pending but at the end she didnt reschedule me and gave me email address to ask for refund.
Also at the end manager came as well and explain we \i cannot come to premium and can only ppost it. When I mention HO guideline he said he is not disputing guideline but this is what we know that your leave expired and you cant vary at premium. He also has recorded in system thou :(

Now I dont understand what should I do I am in just very difficult position :(
Kindly advise me if someone go through same scenario or knows what o do?

u didnt need to mention abt varing as they are admin people not caseworkers who reschedule appointments, , u shld have simply rescheduled.
u have 3c leave

get refund and book another one for some other psc?

I wonder how can you mention that you are varying application when booking premium service appointment?
As if you dont mention it how will they get your passports which are already at some place in homeoffice.

u only need to mention that in cover letter, not on when booking psc,

wat is ur immigraton history?

Hi Paru.org,
I am on Tier1 entrepreneur visa and applied for extension almost 2 weeks back. My husband has completed 10 years and we are thinking to vary application to premium.
I am still not clear how they will decide in a day time and get passports when i wont inform them in advance about varying application. If i inform them only in cover letter how will they get passports immediately to decide on same day?

Thank you for your reply and sorry for bit late response. Yes I have managed to get reschedule my appointment but I haven't received any email yet for new appointment so will see ,I will wait till next week as Its all done over the phone and lady on the phone told me you will receive email or text.

Meesha you they dont ask you anything about variation or else when you book an appointment all you need to mention which application you are booking for.

OP got T1Ent extension granted and then applied ILR LR after that, according to his post below.
