Does sponsor licence date affect TIER 2 VISA extension

Hi,

Just a quick question.

This is my company current licence status.
Licence start date 06 May 2014
Licence end date 05 May 2018
Licence renewal opening date 05 February 2018

Got my Tier 2 in July 2014.
It will end in July 2017.
So I will be extending my Tier 2 VISA in May 2017.

Since the licence ends in May 2018, Do I have to ask my company to extend their licence?
Cause I might get my VISA extension till 2018 only. OR it has nothing to do with my extension?

No it won't affect you visa length. You will get another 3 years.

The only thing is your sponsor must renew their license before 05 May 2018 otherwise your visa will be curtailed to 05 July 2018 (license end date + 2 months). You will receive a letter from Home Office about your visa has been curtailed soon after 05 July 2018.

But do not worry, just remind your sponsor to renew their license 3 month in adavance.

All this information is best of my knowledge. Please add or correct if I'm not up-to-date with the current rules.

Hi all,
Brief info
First Tier 2(General) VISA
June 2013 - June 2015 (2 years)

Worked there until November 2013 (5 months).
They were out of work for me and decided not to keep me.

Then started looking for another company.

Curtailment letter received in March 2014.

Got a new job. Applied for Tier 2 VISA in April 2014 but rejected for not doing RLMT.

Again, did the RMLT and applied. This time got VISA from July 2014 - July 2017 (3 years)
This was the category on COS : Tier 2 (General - Changes of Employment)

This is my Company Licence info:
Licence start date May 2014
Licence end date May 2018

So I will be extending my Tier 2 VISA very soon(probably April/May 2017)
My questions:-
1. When I applied in April 2014, it wasn't an extension. So looking at my above scenario, how many years will i get in my extension?

2. Because the licence end date is May 2018, will it stop me from getting more than 1 year in my extention?

3. Is it true that if you receive curtailment letter, you won't be able to apply for ILR? (one solicitor told me that)

If you apply for ILR based on long residence, it should be fine if it is within your curtailment period as your visa is still technically valid for that specific period.

You won't be able to apply for ILR based on Tier 2 with 5 years residence though unless you switch to another sponsor first.

I was away this weekend!! :?

To apply for ILR based on tier 2 and 5 years residence, it is mandatory to submit a letter from your employer that "you are required in your position for the foreseeable future...." , so if you get that and are still with a valid sponsor, then no problem if you meet the requirements. If you receive a curtailment letter, you cannot apply for ILR based on 5 years residence as you won't be able to get the letter.

My previous answer was related to your point 3!

Actually that curtailment letter, I received in March 2014 when i left my previous company.

But now I am already working in a new company, which I started in July 2014. So it should be fine right?

Hi,
Just came to know that I have no Unused COS left. :(
My Tier 2(General) VISA expires in 14 July 2017.

Can my company ask new COS?
and its Unrestricted COS right?

The company should request a CoS allocation of 1 right away - it can take maybe 2 months for this to come through. Don't leave it too late.

The company can also go for priority application which will cost £200 but cos allocation will be very quick. See link below:

Hi,
Today I and HR member checked that SMS system.
We can see 2 options.

1. Request additional CoS or CAS
2. Request renewal of annual allocation

Under Request additional CoS or CAS, we did not see any option to 'ADD'.

We could not find a premium service.
We could just see 'Tier 2/5 Premium customer service level' and it says £25,000.

1. So we need to go for option 2 right? and it might take 2 months or more.
2. How does the allocation work? Do they allocate 2 per year?

I read that the Salary thresholds for experienced Tier 2 migrants will rise to £30,000 by April 2017.
How can i have an increase of £6,000 just working less than 3 years for a company?v :shock:

Hi Kumar,

Your company should contact employer helpline and ask them how can they get urgent Cos. I am not sure how but I am sure that the company get request additional unrestricted COS any time.

Your company SMS user probably does not know how to do this. Best to ask them to get in touch with Employer Helpline.

The best person to answer this question is your HR Manager. Yesterday, I read on the NHS Tier 2 Employer website and they have mentioned that the new salary threshold will only affect those who got their visa on or after 24th November 2016. This is so confusing and HO didn't give any information on that yet.

According to NHS Tier 2 employer website, they have recently updated all the FAQs and I have also asked one of the best immigration solicitors and they said the same. But I asked them to ask HO about this and now they have asked HO and waiting for their reply. I will put all the information as soon as I get the answer.
