Which visa type for my 2 month old?

Which visa type for my 2 month old?

Hi,

I am currently on Tier 2 General 5 year visa starting November 2014 ending November 2019.

I am trying to apply visa for my 2 month old baby from outside uk.

While booking an appointment, it asks me to select a visa type. What should I put in Reason to Visit? and also the visa type and sub category.

PBS child dependent visa, same as other parent.

What options do you get online (note we can't see what you are seeing)?

First drop down
- Visit
- Study
- Work
- Settlement
- Transit
- Other
- Exempt

If I select 'Work' then it gives me all main application categories then I select Tier 2 (General) - Here I don't get PBS Dependent option. However, it gives a further drop down called 'Visa Sub Type', this gives me the below options:

General Migrant Upto 3 years
General Partner Upto 3 years
General Child Upto 3 years
General Migrant Upto 5 years
General Partner Upto 5 years
General Child Upto 5 years

Select 'Work' and then the GENERAL CHILD option based on your visa length.

Should I select
General Child Upto 3 years or
General Child Upto 5 years

Although my visa was 5 year long, I am mid way (via started in Nov 2014) and will be applying for ILR within 3 years from now.

I think that if current time remaining in your visa is less than 3 years, then you can select the visa type of upto 3 years.If the current time remaining is more than 3 years in your visa validity , then you have to select the upto 5 years option.
I have seen at least one post here suggesting that if your COS is of 5 years, then you have to apply in the upto 5 years category. But that bit does not make much sense to me in cases where the remaining length is less than 3 years.
I will wait if someone has any information based on actual published document. If not, I will go with the common sense approach.

The guidance states dependents leave will be given in accordance with main applicants leave. Even if you have less than 3 years left on your own leave, your original leave condition should apply i.e. you should apply under up to 5 years category. This is similar to paying a 3 years fee even if you were applying for a Tier 2 General for say 6 months.
