Child benefit in your name only?

Post by paradoxical » Tue Aug 01, 2017 9:31 am

Background: I have recently gotten my ILR based on Tier 2. My wife and son are still my PBs dependants and they will only qualify for ILR in 2021. I have searched in the forum regarding child benefit and I understand that I can claim child benefit in my name. (both my wife and son have no recourse to public funds).
I am filling the child benefit form and have filled my details in "About you". It however does have a section asking for "your marital or civil partnership status". Am I not supposed to give details of my spouse who is a Tier 2 dependant? And if I give her details there, am I am still claiming the child benefit correctly?

Yes you must give the details of your spouse. But it is YOU claiming.

Child tax credits, if you qualify, MUST be claimed in JOINT names with your spouse.

Thank you very much CR001.
Just another query in case you have answer. I called the HMRC helpline regarding this but they were clueless.
What original documents should I send along with the filled child benefit application form?
At the moment, I am assuming I need to send, in addition to the form,:
1: my BRP (showing ILR)
2: my son's passport
3: my son's BRP
My son was born abroad so I don't have a UK birth certificate. I can send the foreign birth certificate but I am assuming 2 and 3 would suffice.

And your passport.

You can't have a UK birth certificate if the child was born overseas. You must send the foreign birth certificate.
