Parking Charge Notice during Naturalisation Process

Post by Rizcon » Fri Aug 04, 2017 10:55 am

One of my family friends got two NCP Parking Charge notices for driving the car into NCP parking area to pick her husband. Both of them were not aware of this as they moved to the city recently. She waited to pick her husband once for about 20 minutes and second time for about 35 minutes, but never parked her car and it's totally due to not knowing or reading the rules of the NCP.Both of the incidents happened about 10 days ago and today, they got both PCN Notices.
She applied for her Naturalisation in April this year following 10 years Long Residence and one year ILR and still waiting for the decision and her husband is not British.

I'm looking for the following answers on behalf of this family:

(1) Do she need to inform Naturalisation team / UKVI about it?
(2) Is there any chance they challenge these Parking Charge Notices as she never parked her car unattended in NCP facility as she went to pick her husband and was just waiting to pick her in the car?

(1) Do she need to inform Naturalisation team / UKVI about it? Depends. There is a difference between Penalty Charge Notices (parking violations on public land, issued by council), Parking Charge Notices (parking violations on private land), and Fixed Penalty Notices (issued by the police for a parking violation). Parking Charge Notices are a matter purely of private law. Penalty Charge Notices, while a matter of public law, are not relevant to establishing good character for nationality purposes. A fixed penalty, by contrast, would need to be disclosed as a non-custodial or other out-of-court disposal. So it depends on the specific type of notice your family members actually got.
(2) Is there any chance they challenge these Parking Charge Notices as she never parked her car unattended in NCP facility as she went to pick her husband and was just waiting to pick her in the car? Not sure an immigration forum is the appropriate venue for this question. :) However, the answer will depend crucially on which of the three types of notice your relatives received.

Thank you for your reply.

Both of them are Parking Charge Notice of £60 (Parking on Private land) issued by NCP (National Car Parks Limited) at same location starting with PCN Number: ZP1xxxxxxxx1.
NCP has evidence of just entering and leaving the car park captured by ANPR Camera at the entrance without any barriers or payment machine. No Parking attendant was there as she stayed in her car on both occasions and there were no intentions to dodge the parking changes as she was just waiting to pick her husband in her car and both of them were unaware about it and bit surprised to receive such Parking Charge Notice issued by NCP.

they do not need to disclose anything . the applications are getting decided and these pcn are not some supersonic stuff that would reach the caseworker. they declared everything to the best of their knowledge at the time of the application. the matter is relatively new and they applied in April, i wouldn't worry about them in the least bit.
