Tier 1 Ent ext approved

Post by patrick2017 » Tue Aug 15, 2017 3:23 pm

Hi All,

Finally received my Tier1 ext approval.
My timeline:

Applied :11oct 2016
Decision: Rejected 29Nov2016 due to lack of documents
AR submitted same day with the missin documents
AR rejected 26Jan stating we cannot accept the missing documents in AR
Fresh application: 8th Feb2017
Biometric:19th Feb 17
Complex letter 9th March 17
Online Decision update: 9thAug
Approval letter with docs received 11th August 17
IHS: 14th August 17
Biometrics: awaiting

Thanks everyone for posting the useful information and supporting members.
My questions to the senior members are:

1. I am under transitional agreement so do I have to continue keep employing my current employ for another 2 years?

2. If I intend to upscale my employees if the business is doing well, would my current state allow me to be able to hire another employee for 12 months. Under this scernario would I be able to apply for ILR in the next 14 months cause I just waited for 10 months during my 2 application process.

Best,
Patrick

1. Since you are under transitional arrangement, you only need to have the equivalent of 104 weeks of FT employment. That needs to be satisfied between 11th of August (or whatever the actual visa start date is) and your date of application for ILR.
2. You can apply for ILR once you have completed 5 years and have completed 104 weeks of FT employment.

@Marcnath Thanks for your reply. If I understood correctly, if am able to complete 104 weeks of employment in the next 1 year and because my Tier1 Ent was issued in Oct 2013(3yrs), waiting period Oct2016 to August2017(10 months) So I should be able to apply for my ILR sometime by November 2018 which should my 5yrs on tier1 Ent visa.

Pretty much yes. Depending on when you came, you can apply 28 days before you get to 5 years

I heard from my solicitor you can apply for ILR after 5 years completed. this will count visa issued date not once you arrived. for example in my case i arrived Uk after3 months once my Entr visa issued, So i can apply once 5 years completed, I would suggest check with your solicitor and senior members on this forum.

Thanks,
HR

Hi Patrick,

First of all congratulations on your approval :D :D :D And hope that the next part is easier than what you just went through.

I just wanted to ask you if you were made to report after your AR refusal.
