Overseas Students & child born in the UK - Citizenship q

Post by gollywood » Thu Feb 28, 2008 9:03 pm

HI

Good friend of mine has been studying the UK for about 3-4 years, and his wife is here also. They are from Pakistan.

They are planning on going back after the completion of his course.

What status does their baby son have (he is 6 months old).

Neither the parents are EU nationals - they are Pakistani passport holders.

Is the daughter regarded as British?

The baby is Pakistani. Merely being born in the UK does not confer automatic British Citizenship. This has been the case for about 20+ years now.

The child will be eligible for registration as a British citizen once one of the parent obtains settled status in the UK, such as ILR.

Thanks for prompt response.

But as students, they would have no obvious right to remain in the UK - would they? Otherwise no students would ever go back?

even if both parents are British but baby born in oversea, the baby still consider as a British citizen. Doesnt matter where the baby born, immigration only consider what the parents status.
