HELP! What kind of questions do they ask at appeal hearing?

Post by MSS » Thu Feb 28, 2008 10:30 pm

For anyone who has been to a hearing, can you tell me what kind of questions they ask. Do they only ask Q's that relate to why the application was refused, and the new evidence we provide? Or do they ask other Q's about relationship, etc...

They ask "why are you appealing?"

Hi when is your appeal, ours is in about 5 months and I would be very interested to know what kind of things they will ask. I don't think people making jokes is really very helpful at a time like this.

Actually Syn's question is perfectly valid, they want to know why you think their original decision was wrong. Think about it.

Yes, i suppose it makes sense.....it just seemed like a very brash reply. Well apart from from that question (which is the whole point of the appeal), are there any other questions they ask?

Yeah, Syn is one of the GOM's here like me - Grumpy Old Men...

U see we hang around here for free and sometimes the same questions come up and the OP hasn't searched and grumpiness outpours...

Sometimes we answer, sometimes we say 'use the the search function', sometimes we say 'Are u fukin' stupid....etc' depends on mood I'm afraid. Except Syn is always moody, I'm nice at first.

Then I'm moody!

But we all do it for free, some are polite, some aren't, wrong or rights it's all free and 90% of it is better advice than most 'immigration specialists' give if u can filter out the wood from the chaff with the brain of a ten year old.

They will ask u to show new evidence to support what they had failed u. They will only ask how is ur relationship if they suspect its a convinience marriage i suppose. Only questions for the points of refusal. No stupid question, and no jokes. Hahah... If they refuse u because of finance, than they will ask more about it. U should be prepare to answer more question about that. Just make sense

Thank You Wanderer and SYH on your in-depth character studies of the people who are regulars in this forum; most helpful (!).

Thanks Kitty -
Basically I'm hoping the Home Office representative wont be asking any trick questions trying to trip me up....Ive heard they do that. The main reasons for refusal i think we've fulfilled with the additional documents - as long as they dont find something new to pick on and refuse it - im very scared. This is probably the scariest thing I've had to do my whole life - worse than uni exams and childbirth!

They can ask anything they want...though if they go too off topic a good judge will tell them to stop. They may also try to trip you up, that depends on how nice/good the HOPO is. Statistically, I find that about one in 10 is an absolute sod, most are pretty efficient and reasonably fair.

Don't worry about it, it is a pretty informal process and the judges are also usually pretty reasonable. Just be honest about everything.

When is your appeal MSS? My sister is on income support so her husband visa was refused now she is waiting for court hearing date. Would you let me know what sort of question judge asks you?

I pray that everything goes well for you.

Previously my ECO did not submit the bundle in the required time for my appeal. My case took 2hours to finished. 80% of the time is just my Barrister talking , the HOPO had less question to ask as he does not have the bundle to support him.

Is there any chance that the judge can turn around and dismiss the appeal on completely new grounds, even if the original reasons for refusal have been met?
