Unanswered question till now!

Post by cooldude143 » Sun Mar 09, 2008 3:36 pm

Guys,

Can you please help me? It’s regarding the secondment earnings

I was in UK from 01-04-2006 to 27-07-2007 and i am claiming HSMP for the below periods.

1. 01-02-2007 to 27-07-2007 - in UK
Salary credited in India as rupees and allowance paid in pounds.
I have Indian salary slips and it has mentioned the location as UK in the salary slip. But my July 2007 pay slip shows the location as India since on 31-07-2007 was in India.
I can't produce proofs for UK since my employer won't produce P-60 and only proof is allowance credited to UK bank account.

2.28-07-2007 to 31-01-2008 - in India
Salary slips and bank statements as evidence.

I am worried that my case will confuse the case worker. My only worry is how to show the earnings during the UK period. Will the location specified in the salary slip would be sufficed.

I dont see that it is so confusing for the case worker. You don't think they don't see this all the time. I dont know how they will evaluate the allowance in terms of salary so maybe someone else knows but if you don' t need it to put you over 75 points then I wouldnt be concerned about it

Please refer the below from HSMP guidelines.

Those seconded overseas from their normal country of work.
Applicants who have been seconded overseas during the last fifteen months and
whose salary continues to be paid in the normal manner by their employer should be
assessed against the country where they have been working during their secondment.
In order for us to establish which country code to consider their earnings against, the
applicant should provide evidence of where they have been working and where their
salary has been paid for the period they wish us to consider, up to a maximum of
twelve months.
If an applicant is working in a country but having their income paid into a bank
account in another country, their income will be considered against the country code
where they are working.
