Tier 1 Entrepreneur to ILR Drink and Drive conviction

Hello members and zimba,

Please disregard my previous post.

I am currently on Tier 1 Entrepreneur Extension visa and due to apply for ILR in March 2019.

I have a drink and drive conviction.

Could you please advise if that is going to be a negative point and a ground for refusal>

Drink driving is inexcusable and irresponsible so I'd expect the path forward to be exceptionally fraught.

Hi Zimba,

Thank you for your reply.

They have still not decided as the matter is still in court. If the charges go ahead, then I guess the verdict would be minimum 12 months disqualification from driving and a fine.

So, if it is the case, then should I apply for ILR or not? What are my options?

Please advise.

If you are convicted of the offence at court, you will have to wait to apply for ILR. My understanding is that you will have to wait 24 months from date of conviction for it to be spent.

If you cannot apply for ILR, you can apply for 2nd extension of T1e. Make sure you have the maintenance and jobs like first extension

Assuming you get a non-custodial sentence, you cannot get ILR within 24 months of your court conviction. You need to apply to extend your Tier 1E visa in March 2019 until your conviction is spent. You also need to satisfy job creation again for your ILR

Moreover, this is should be a relatively easy problem to avoid. Just don't drink and drive!

If I have to apply for second extension, I assume the same rules will apply. I have to:
1) Create 2 separate full-time jobs (cannot combine one or more jobs)
2) Investment of £50k

Please advise.

1) Yes
2) You don't have to invest again - once you have been awarded points for investment, you can claim points for any future extensions without evidence
