ILR Dependents

Post by Shah05 » Mon Mar 19, 2018 5:14 pm

hello,
I was on ILR till 2017 and having British passport now. my husband arrived in UK in may 2010. After 1st entry and couple of extensions, he applied for his last dependent visa on sept 2015 on based on ILR dependent using FLR (M) and the extension is due in a month time (Ideally we can book an appointment anytime now)

My questions are,

1. do I have to use for his further extension using FLR (M)?
2. Is there any other route I can make an application from?
3.could I have applied for any shorter route in past to get his ILR sooner? (I know this is not relevant now but want to know if I have missed to get the appropriate information).
4. Planning for PEO, in London apart from croydon is there any other center can we apply to? (As we are not living in London)

Appreciate your response in advance.

Thanks

1. do I have to use for his further extension using FLR (M)?

Yes
2. Is there any other route I can make an application from?
No, any other route will reset his ILR clock to zero.
3.could I have applied for any shorter route in past to get his ILR sooner? (I know this is not relevant now but want to know if I have missed to get the appropriate information).

Yes, but only if you applied for ILR based on Tier 1 Ent. As you applied for ILR based on long residence, he had to switch to FLR(M).
4. Planning for PEO, in London apart from croydon is there any other center can we apply to? (As we are not living in London)
You can apply at any of the centres (Liverpool, Glasgow, Belfast, Sheffield, etc).

You will have to pay the visa fee, which goes up on 6th April, as well as the £500 Immigration Health Surcharge.

He also need English A2 for FLR(M) extension and the financial requirement (salary per annum) must be met again as well as evidence of cohabitation and subsisting marriage for 2 years preceding the date of application.

Right now my husband's type of visa says spouse/ partner LEAVE TO REMAIN, now they have given options

''Your application type

What type of application are you booking an appointment for? (Required)

PBS Work and Dependants

EEA or CR Resident Permit

Further Leave to Remain

Settlement ''

whichn one should i select? If I am on wrong link can you please direct me to the right link?

yes thats true, well unfortunately cant get the near date before visa expiry so planing to apply through post. In that case do we have to apply online? or just have to fill the form and send the documents through? We do have two minor dependents who holds british passports. Do we have to send all the passports by post or can send a copy of the passports? Pls advise.. Thank CR001 :)

Paper form is fine if applying by post.

Copies of children and your passport is fine.

hello, As my partner and I are filling the application form, we found a question which is bit tricky to answer and I would like to ask your opinion on this matter.

The question is :Do you and your sponsor have any shared financial responsibilities?

Now currently only my husband (applying for flr(m)) works, and source of income is only depends on him. In this situation, If we said YES,than we need to provide details which of course we could do as we have many utility bills, council tax, and etc. on joint names, But how can we justify their question, as I have no income currently? In this case what should be the answer?

thanks in advance

We have posted an application for flr(m), but haven’t received any Confirmation letter. Is there any way to contact HO? As I have read many of people haven’t received any confirmation letters. As my husbands employer is been chasing we need to provide some sort of proof apart from proof of posting and bank statement showing money has been taken out.

Please need your help to come out from this situation.

It was in 28th March. I assume I might be asking this question early but employer is chasing and I am not having anything in hand so need some solutions. As visa is running out on 18th April.

Has the biometric enrolment letter been received?

The employer can also use the online Employer Checking Service to confirm the person has a right to work.

Also, google Section 3C of the immigration rules, this extends his visa conditions if the visa expires and an application was submitted before visa expiry.

Thanks for your response. No he hasn’t received any biometric letter so far. In this case if employer use online employer checking service would that be helpful to obtain information of the current application to them?

About section 3c, as he has made ontime application his visa continues. But how can we prove this to employer if online employer checking service results gets negative as we haven’t received any biometric letter. Plz advise.

the online checking service is purely to let an employer know an applicant has the right to work etc. However, might be difficult if you don't have a case ID or reference number. Doesn't tell you anything else regarding the application.
