Employment contract date after CoS start date

Hi all,

Need advice and help on this urgently.

My start date on the COS is: 29th October 2018.
Contract date with employer: 1st of Dec 2018.
The Date of Intended Travel: 2nd of Nov 2018
BRP receive around: 10th of Nov 2018

Does this cause any issue with HMRC or Tier 2 extension or ILR?

I basically need 2-3 weeks to search for flat, etc and settle in the UK before I start.

Kindly advice.

Hi there,
Your start date with your employer cannot be more than 28 days after start date mentioned on your CoS otherwise sponsorship will have to be withdrawn. As I understand, it is section 323AA of the immigration rules.

This is the extract I was given by xxxx (the immigration consultants) for my job start dates;

“if such start date for a Tier 2 (General) migrant is subsequently changed after leave has been granted, it must be within 28 days from the later of:
• the date on which their entry clearance or leave to remain is granted
• the start date on their CoS.”

The rules have changed in 2018 so now the maximum delay to start date can be no longer than 28 days.

Hopefully others can provide their experiences.
