5 Year Stateless Child Application

Hello,
My child has applied for 5 year stateless application. Still I home office has not taken the fee of £1012 from my account. Can I please know how long they take to,
01. Take the fee from my account
02. Send biometrics letter
03. Take decision

What are the parents nationalities?

What are parents immigration status?

How old is child?

Also, where was the child born?

What are the nationalities and immigration status for both parents?

If the flag on your profile (Maldives) is correct, then your child would be a Maldivian citizen by birth (Section 9(a)(2) of the 2008 Maldivian Constitution) and therefore not be eligible for registration under stateless provisions.

sorry I don't know why Maldives flag in my account. Me and my wife both from sri lanka and over stayers for 14 years in the uk. Application got delivered to them a week ago. child was born in the UK in Manchester, had claimed asylum and refused for all three of us. age 5 years and 2 months old. never registered birth in sri lanka. Surely your child is entitled to Sri Lankan nationality and is therefore not 'stateless'? :idea:

Stateless applications can take up to 3 years to process and to date there have been only a very small percentage approved.

Casa, as with most things on these forums, things get complicated because of different sets of law.

The judgment that you referred to was based on the Immigration Rules, which looks at whether the child is admissible to another country. And therefore refusal of the parents to register the child as a citizen of another country was taken into account by the Court of Appeal. The Court of Appeal ruled that as registering the child as a citizen would give him admission to another country, he was not stateless for the purpose of the Immigration Rules.

However, the High Court ruled in the MK judgment that for the purpose of the entitlement for registration as a British citizen under Section 3, Schedule 2 of the British Nationality Act 1981, only the fact of statelessness needs to be looked at, not the manner in which the child became stateless. "Ability to acquire a nationality is irrelevant for these purposes" (paragraph 36 of the judgment).

That means that, perverse to the purpose of Schedule 2 (Reducing Statelessness), children born to parents of countries where citizenship by descent is not automatic (such as India, Sri Lanka, Australia, etc) are incentivised to make their children stateless by not registering their children as citizens of those countries.

Is there anybody who applied and got 5 year kids stateless citizenship which is currently open for a few Asian countries? If yes please let me know how long the application process took? Thank you.

Very few members have posted about this and I cannot recall any being recent.

Nothing you can do but wait. It can take a couple of months or it can take many months and as you only applied a month ago, you might need to be a bit patient. There is no way to speed up the process.

If we apply under private life or something premium service, will there be a chance I will loose all money? I have seen so many solicitor firms advertise on Facebook saying they do premium service for we type of parents. any advise much appreciated.

Parents claim child benefits NOT children so no, you cannot claim if you have no legal status and no recourse to public funds.

I heard the visa which parents get under this rule does not have access to public funds too. so that means until parents get indefenete leave to remain, the situation will be the same right? Thank you.

It can take a couple of months or many months. Some people have been waiting for a year or more.

There is no guarantee that you will get a visa.
