Tier 4 Visa Curtailed and I made a wrong statement to University

Post by stopz » Tue Dec 18, 2018 3:42 pm

Hey guys I hope you can advice this problem to me,
On friday 14th of December I receive an email from my University stating that they are curtailing my visa because I did not attend to a lot of classes, I made an excuse by saying that I got financial problems and that my parents who sponsored me was unable to give me money so I had to work extra hours and getting paid by cash and that is the reason I missed classes. I understand from my statement I thought I can get away by lying to University and all of the excuse above was not true.

The University replied to me by saying that they also will report me to the UKVI as I admitted in writing that I was working extra hours and paid in cash. Until now I have not withdrawn from my university just yet and they will start reporting me to withdraw their sponsorship to me and also report me for working extra hours and paid in cash.

I am not worried of getting withdrawn as I can find some other universities and do credit transfer, but what I am worrying is that the UKVI will arrest me and deport me and prevent me to apply for visa in the UK/banned me. is there any way I can justify my action and prove to the UKVI that I did not doing that? that I was just made excuses to University in hope i can safe my self but apparently it made it worst.
and what is the scenario that likely to be happen now?

Universities cannot curtail visas as only the Home Office does. Univ will report to UKVI about a student's continued absence.

Very serious as you've admitted yourself in writing.

There is no justification for breach of visa conditions and yours is extremely serious.

Highly urgent you need specialist immigration advice from your university visa team or outside.

I understand this, i wasnt aware of what I am writing until My lawyer who stated that I unlikely win this curtailment from UKVI because I said those things.
But I have contacted my lawyer for this matter asking him what will actually happened and how to solve this.
I will keep you updated, as far as im concerned The University have not report me to UKVI in terms with withdrawal of the sponsorship of my visa.

For non attendance, they will likely report you soon and your visa will be curtailed.

You also no risk not being able to get a CAS from another university to 'continue' your studies.

How long have you been in the UK on a student visa??

Ive been in UK since May 2016 and suppose to get my degree in january 2019 but well i didnt attend the class so i inow the consequences, the programme support told me that I will receive my final transcript and diploma of higher education because I have completed level 4 and 5 and 45 credit on level 6.
My visa will expired on May 2019 but now im expecting to go home on february. Or late January.

Now the problem is just about the statement false statement that I email to the university about extra work that i did. They will also report it to the UKVI, im just afraid i will face hard prosecution basically. Or ban from the country or fine or jail time? Sounds crazy but i wasnt aware when i wrote the email to the University.

Yes it is very serious. As the saying goes 'act in haste, repent at leisure'.

You could well face a ban from the UK, only HO can decide that but they do take breach of immigration rules and visa conditions very seriously and you have left a paper trail now.

Ok this is might sounds like a stupid question.
I will expecting the withdrawal of my visa/curtailment, but what is the chance that home office will also process the report from University that i had been working extra hours ? I am talking to the lawyer at the moment but just want your point of view.

And also when university reply about me working extra hours, I also replied by saying there were missunderstanding and explaining that I never work pass my work limit 20hrs/week and basically not illegally working as I understand that is breach of visa and immigration.
But what university said is they have to report me of missing attendance because I was working and aso did some extra work, they said its up to Home office if they want to investigate it.
But mehhhhh,, if i knew the risk is this high and serious i wouldnt done it 🙄

If you didn't work more than 20 hours per week, there was no breach of your work conditions anyway. Or were you lying about that too?
I do not give immigration advice. I refer you to Immigration Rules, guidance, other online content and to your sponsor.
