Mn1 , section 3.1 and 3.2

Hi,

I have a bit of a situation here. I am applying for my son citizenship and i am having a problem with the Mn 1

Section 3 - Parents’ residence in the UK or the British overseas territories, where applicable,
3.1 State which parent is the one who is a British citizen by descent and on whom this application is based
3.2 Provide the above parent’s addresses in the United Kingdom or the British overseas territories during the reckonable 3 year period

basically I have obtain my citizenship in 2018 after 10 long years staying here.My son was born in 2016 abroad. We don t live in the uk anymore . Do i need to fill the 3.1 and 3.2?

They may expect the child to be living in the UK, etc.

Do click on the link that vinny has provided (clue is the word MAY).

A child born abroad is usually expected to have 2 years residence and hold ILR before they can apply when one parent is already British and the other parent holds ILR.

They have no entitlement to register as British if born abroad before you got ILR or British citizenship.

It is completely irrelevant if the child was born abroad. It would only make a difference IF the child was born in the UK, which you state they were not.

In order to register as a British citizen, children born abroad are expected to hold ILR/PR themselves, with at least one parent either holding British citizenship or applying to become a British citizen and the other parent holding ILR/PR. Registration for such children (born abroad) is not a right, but at discretion under Section 3.1 (Section 3.2 does not apply as you are not a British citizen by descent).
