Tier 2 dependent VISA when spouse already have British citzenship

Post by smaraza » Thu Jan 31, 2019 8:47 pm

Hi there,

Please help.

> My wife first landed in the UK on 4 Sep 2013 on tier 2 dependent visa. She completed 5 years in the same category
> Her last extension was in the same category in 2016 when I already got ILR.
> Now I have British citizenship

I need to know the following

1. Under which category she will apply for ILR?
2. Which form should be used (kindly share the link)?
3. Any other thing I need to be aware of?
4. What documents need to be attached?

The fact you have British citizenship has no effect on her ILR. You were granted ILR under PBS which means she can be granted ILR under SET(O)
1. Under which category she will apply for ILR?
2. Which form should be used (kindly share the link)?
Apply under SET(O) online
3. Any other thing I need to be aware of?
4. What documents need to be attached?
LIUK pass certificate
English language proof
Cohabitation documents

Many thanks.

Could you guide me on Cohabitation documents please?

From Set O i understand we need to provide documents from 3 different sources.

Q1: Do we need bank statements for last 5 years or only past 2 years?
Q2: For bank statements do they need to be every single month in last 5/2 years?
Q3: We do not have joint bank account, we can provide bank statements individually, my understanding is that bank statements from both us will be considered as 1 source of document. Am I right?
Q4: We have council tax bills in joint name, thats would be source 2?
Q5: All the utility bills are in my name and not in my wife's name and almost all of them are paperless? Can I use them at all?
Q6: We have many NHS letters again in individual names, can we use them as one source?
Q7: We have daughter together and her birth citficate have both of our names. Will it be any help?
Q8: Should I attach pictures of us on various holidays in past 5 years?
Q9: My wife did several temp jobs, and she has letters from them too, are they any helpful?

Sorry for the long list and many thanks in advance.

From Set O i understand we need to provide documents from 3 different sources.
Tenancy agreements, council tax, utility bills, NHS letters, HMRC letters etc etc, covered many times on the forum and should be from 6 different sources.

Q1: Do we need bank statements for last 5 years or only past 2 years?
No, neither. Last couple of months only.
Q2: For bank statements do they need to be every single month in last 5/2 years?
See #Q1.
Q3: We do not have joint bank account, we can provide bank statements individually, my understanding is that bank statements from both us will be considered as 1 source of document. Am I right?
I believe so yes.
Q4: We have council tax bills in joint name, thats would be source 2?
Q5: All the utility bills are in my name and not in my wife's name and almost all of them are paperless? Can I use them at all?
Should be fine.
Q6: We have many NHS letters again in individual names, can we use them as one source?
Yes.
Q7: We have daughter together and her birth citficate have both of our names. Will it be any help?
Yes.
Q8: Should I attach pictures of us on various holidays in past 5 years?
NO!! This would be ignored and is overkill.
Q9: My wife did several temp jobs, and she has letters from them too, are they any helpful?
If they show address, yes you can use them.

Sorry for the long list and many thanks in advance.
