immigration told my husband to appeal while serving his sentence for 13 months

Post by divined » Wed Mar 13, 2019 10:03 pm

Hello, I really don't know what is going on and this is worrying me. My husband has been in prison for using a passport that wasn't his own, but he also have immigration issue, the immigration came to him in prison to appeal in 20 days as he is likely to be deported because of his sentence. I am British, we are married and pregnant for him, I really need him here with me. does he have the chance of staying here in the UK legally :)

For anyone here to give you any kind of informed opinion you need to give details of your husband's immigration history and what is the current basis of his stay in the UK. Presumably he is not a British citizen? Clearly using a passport ilegally is a serious offence which will affect his options for staying in or returning to the UK, if he is deported.
This is just my opinion as a member of this forum and does not constitute immigration advice.

he came to the uk with visa and he overstayed, he started working with the passport to support himself but later stopped using it. he is is staying here because he wants a new life for himself here, to settle down here, have a wife, child and we have been married now for about 9 months or so and I am pregnant with his baby.

What visa did he come to the UK on?

When did he come to the UK?

How did you get married, at a registry after Jo approval or an Islamic marriage?

Possibly, hence the jail sentence.

So my question again is, did home office give approval for you both to marry??

How did you do a family one in Nigeria if your spouse is an overstayer??
