Tier 2 valid if unemployed?

Post by Botman » Tue Apr 02, 2019 3:30 pm

Hello all. I resigned from my job and it ended on 31 march but my visa is valid till 15th May. I have an exam on 9th April in home country. Can i travel on it outside Uk?
I understand that my employer will inform HO about my end of employment. I called HO and they said if ur employer informs us about ur end of employment while you’re in home country, you might not be able to come back. Any idea how long does it take for employer to inform HO? Should i ask HR about it?

Also i have been waiting for a Cos from my next employer since one month who have applied to HO for the reallocation of their CoS but still haven’t gotten it and have no idea when they will.

Any way around this situation?

Also any idea how soon can i get an appointment for my biometrics if I submit a super priority visa application? Can i get it on the same day or next day after submitting application?
I have asked one of the other employers to issue me a CoS

They are required to do it within 10 days after your last working date.

How soon do i need to apply a new tier 2 visa?
If i have resigned but my brp is valid till may, when do i need to apply for new visa? Do we have 60 days period now in which we can stay unemployed without consequences?

Im waitind for cos from my new employer.

There is no longer a 60 days employment gap restriction for tier 2.

You need to apply for a visa before your current visa expires, once Rlmt has been completed and you have been successful and assigned a CoS.

If you can't get a job and sponsor, you need to leave the UK by 15th May or potentially find another visa category you qualify for.

I understand from what you said is we cant stay without visa for a single day? And have to apply for the new visa before the last one’s validity runs out? Which it will when my ex-employer now informs HO as i have left the job.

If you remain in the UK after your visa expires, you are an overstayer. There is a 14 day grace period if there are 'exceptional or compassionate' reasons why an application for further leave to remain was not submitted in time (i.e. severe illness, hospital admission, death of immediate family member, etc), but you will still be an overstayer until a decision is made and you will have no section 3C protection, ie not allowed to work, free NHS use can be an issue and right to rent can be an issue.
