Naturalisation question related to EEA - EU permanent residence

Post by ariskar » Thu Jun 27, 2019 8:51 am

Are you either:
*An EEA national who has been issued with a permanent residence document
*A family member of an EEA national who has been issued with a permanent residence card

Yes / No

My wife is applying.
I am an EEA/EU national who has been issued with a permanent residence document EEA(PR) and then became BC.
My wife holds ILR under UK immigration rules, she was never my dependent and holds nothing from Appendix(EU).

Technically she is: a family member of an EEA national who has been issued with a permanent residence card

But she is not: a family member of an EEA national who has been issued with a permanent residence card

What should she answer in the online naturalisation application form?

Tick no as her route was not the EEA route PR but the ILR UK immigration route and she is applying as spouse of BC, which is all that is relevant.

Dependants in naturalisation application

Post by ariskar » Thu Jun 27, 2019 9:03 am

Do you have any dependants not applying with you at this time?

Yes / No

Per the dictionary: "a person who relies on another, especially a family member, for financial support."
Technically by definition all children in your care are dependants.

Do British citizen children count as dependants for the purpose of the naturalisation form?

Spouse is BC (6.2), child(ren) are BC, single non-EEA ILR applicant case.

Thank you for the guidance CR001.

Could you or anyone else provide some insight for the definition of dependant in form AN?

Thanks.

You have a BC (meaning you are part of EEA), but you obviously do not have a residency card. Your wife is non-EEA, isn't she?

I think you should answer no.

I think you should answer no.
I have a permanent residence certificate issued by UK based on my EEA nationality and 5 years of continuous residence.
