Immigration fingerprints

I applied and failed asylum in Spain in 2003. Moved to England in 2005, after being granted a work permit in 2017, the Home Office are using my 2003 fingerprints from Spain to send me back to Spend after more than 10 years in UK. Is it legal? If not what are my options?

How did you move to England in 2005, on what visa?

What work permit do you currently hold?

Have you at any time used a f a k e or someone elses identity or claimed to be a different person?

Claimed asylum in Uk and was granted a stay on 6 years route.

If you are holding a valid leave then why UKVI is sending you back to Spain. Have you got any court proceedings or serious criminal issues there? Also if that discretionary leave was granted before july 2012 then it could have enabled you to apply ILR after completing 6 years.

I was given a stay in 2016. I have no criminal or court issue in Europe whatsoever, maybe minor court issue in England but I had my DBS return clear in January. They are claiming my fingerprints matches with the one taken in Spain more than 10 years. That's why they are holding my application for a discretionary renew. Do they have the right to do so? What about my family and all my taxes in this country?

Hi. How you get Visa in UK in 2016. And they give you 2.5years Visa or 5 years

There are rules against claiming asylum in multiple countries. You are expected to claim asylum in the first safe country that you come across when you are fleeing from violence/political developments.

If you claimed asylum first in Spain, then it is likely under the Dublin III Regulations that the Home Office will attempt to return you to that country as that is the first country that you claimed asylum in.

Your family should move with you. And taxes are paid in whichever country you work/live in. That has nothing to do with your legal residence. Your obligation to pay tax is separate and distinct from your legal status in the country. Even temporary residents in the UK pay taxes.
