Dear All

I was wondering if this would constitute 'access to publics funds'

https://www.gov.uk/marriage-allowance

I intend to back date this a couple of years, however my spouse has only entered the UK in the last 28 days.

Not public funds.

You cant back date it to pre spouse arrival in the UK.

The requirement is that both spouses need to be resident in the UK to benefit from the allowance!!

Hello

This doesn't look like public funds.

However, I am not excited about the idea of backdating. Your wife wasn't in the country during the last 24 months so she doesn't have any tax personal allowance to transfer to you.

But please see with a tax adviser. The last thing you want for your immigration history is an issue with HMRC.
