Application for Spouse

Hello All,

Thanks for your previous assistance.
Please I need some info.

I have recently acquired my ILR (10 years route) but was previously on Tier 2 General.
I got married in Sept 2016 and my wife came over to join me in the UK October 2016 as a Tier 2 dependant.
We also recently had a baby (March 2019)

My question is. What is the best and most cost effective visa to apply for her now?
Do i apply for citizenship (MN1) for our child and then she applies as parent of a British Citizen
or
Do we apply under the FLR(M)?

As you were granted ILR under long residence, your wife will have to apply under FLR(M). This will re-set her immigration 'clock' to zero, putting her on a new 5 year path to settlement (ILR).

my question was which is 'better' to do?
ie: Apply for my spouse with FLR(M) or apply for her as mother of a British citizen (whereby i do my childs application first...)

If you're referring to the FLR(FP) Parent route application, this is a 10 year path to ILR and is for someone who is living separately from the other parent. This isn't relevant to your wife's situation and she needs to submit a FLR(M) application.

Please when applying for my wife's FLR(M) do we need to meet the 22400 or 18600 requirement?

As previously stated, we have a son who was born here in the UK but he wont be applying with her as a dependant as we are in the process of applying for citizenship for him under MN1

If the child is NOT yet British, HO would likely expect to see the 22,400 income requirement. If the child is already British, then the lower amount.

You don't state in your posts when the current visa expires.

Her visa expires end of this month.

Only a British child is not included in the financial requirement. If the child is not yet British, then yes, HO will likely expect to see the higher financial requirement.

Got a question on the form saying:
If u were required to leave the uk...

Are there any factors that will make it hard for you to integrate and establish a private life...

Can she state that her immediate family (husband and son) are based in the uk and she has been away from her home country for a while so she would find it hard to reintegrate...

Or can someone please help me with an answer
