Confused about FLR(M) & SET(M)

Post by coolbrittania » Tue Sep 24, 2019 1:04 pm

Dear Sir/Madam.

I need your advice. My visa history is below mentioned
I came in UK on 15th December,2009 on student visa and I continue my student visa til 15th March 2014.
On 15th March 2014 I was granted Tier 2 dependant ( My husband that time was on Tier 2 visa)
On 25th April 2017 I was granted FLR (M) visa for 30 months .

My husband is now British citizen ( He got ILR through 10 year long residence while on Tier 2 Visa).

Now my confusion is my FLR(M) is expiring on 25th October,2019 .
Should I extend my visa by FLR(M) extension or should I go for SET(M) as I completed more than 5 years as dependant visa. First dependant visa I got in March,2014 and then second dependant visa I got in April,17.

Many Thanks
Deepana

You need 5 years on FLR(M) visa to qualify for ILR on SET(M). You will need to apply for an extension and meet the A2 English and financial requirements again.

You cannot combine PBS Dependent visa with FLR(M) visa to make up 5 years for ILR.

You obviously can apply for Long residence ILR in December if you meet all the requirements.

Extend FLR(M). You need five years under FLR(M) to be eligible for ILR. Time spent under PBS route does not count

Dear CR001,

Many thanks for the information. Please advice me one thing more.
Can I apply my FLR(M) extension on 25th October,2019 ( Last day of my visa) and Vary my application to ILR (LR) on 18th November,2019( As I qualified on this date for long residence).

Dear Moderators,

Recently I applied for SET(LR) on Super Priority at Croydon.

UKVCAS appointment: 18th Nov,2019
Caseworker Email: 21st Nov,2019 (Asking for more paperwork)
I send it straight away in 5 minutes.

Now I got an email from them saying

" Thank you for your email and providing the attached documents.

I can confirm a grant decision has been made on your application .You will receive further documents in the post to confirm this."

Can anyone please explain that decision has been taken or I am granted the visa?.

Many Thanks

It clearly says the "grant" decision has been made.

Just wait for your approval letter and BRP to come by post.
So verily, with every difficulty, there is relief.
