6 week rule explained!?

Post by mmsa » Mon Nov 25, 2019 11:28 am

Hi All!

Can someone please clarify. This 6 week absence rule that is allowed in the year before application for naturalisation.

My question, is this 6 week rule per year (Jan to Dec) in the year before application. or is it the 12 months before the month of application?

Example, you went on a 6 week holiday in November 2019. Then a 2 week holiday in Jan 2020, then decided to apply for naturalisation in Feb 2020. If this rule meant the year before (jan - dec) then this would be within the 6 week limit. If it was the 12 months from date of application then this is not with the 6 week rule.

Can someone please clarify?

It's the 12 months prior to your application. So if you apply in Feb 2020 you calculate from Feb 2019.

It is 6 weeks prior to the date you submitted your application or/and 2nd stage.
Previous more than 6 weeks, rolling per year(it can be sept-sept) should be subtracted from there residence date you have. I've send all my days away by citizenship calculator with my application, to make INIS Job Easier and put comments for those away days.

Its dependent of the reviewer... in my wife's application case.. we used the 6 week period in the last 12 months prior to application date but they rejected the application and started following Jan to Dec.. its all dependent on the mood of the interpreter. :)

Wow!!, this is unbelievable....did you appeal against it? It has to be same for all the applications, i.e., last 12 months from the date of application.

Yes i did appealed against it... but all they need is our money.
They rejected the initial application and applied again after some time... obviously paid for all the costs, verifications, printing and despatch, applicaiton cost etc etc. By the way... still waiting for their response, i applied in mid 2017.
