ILR Application for Main and Dependant at the same time

Post by moumita28 » Fri Nov 22, 2019 1:26 pm

Hi

I have Tier 2 Work Sponsorship Visa. My husband is my dependant. We entered UK Feb 2015, Mar 2015 respectively. We would like to apply for ILR Feb 2020. My husband has his Job under Tier 2 dependant Visa.

Questions:
1. Can we apply at the same time?
2. Do we need to fill separate application form? A brief explanation would be helpful on this.

Thanks in Advance.

ILR application Eligibility date

Post by moumita28 » Thu Dec 26, 2019 7:58 pm

Hi

Our Tier 2 (General Sponsorship) visa issue date is 14 Jan 2015. Main applicant entry date is 19 Feb 2015. Dependent person entry date is 16 March 2015. Dependent was out of UK for 150 days in the year 2015.

We are planning to apply for ILR in Feb 2020.
-- Can we apply before that?

Any clarification would be helpful.
Thanks in advance.

5th anniversary minus 28 days from visa issue date. So you both already qualify as of today (or 17th Dec 2019).

Leave granted on or after 11 January 2018

Post by moumita28 » Sun Dec 29, 2019 11:45 am

Hi

I have Tier 2 Work Sponsorship Visa and applying for ILR. My husband is my dependent. Our visa and extension is as follows

Main applicant -
14 Jan 2015 - 01 Jan 2018
14 Dec 2017 - 14 Jan 2021 (Extension)

Dependent -
14 Jan 2015 - 01 Jan 2018
15 Jan 2018 - 14 Jan 2021(Extension)

Please advise on the answer for following question(s) for Dependent.

1. Does the period of stay on which this application was based include any leave granted since 11 January 2018? Yes or No
--- I think it would be Yes as his extension is after 11 Jan 2018. Please suggest.

2. Have you had any absences from the UK during any leave granted since 11 January 2018?
-- If answer to the question 1 is 'Yes', I guess this is also 'Yes' as he has been to India on vacation after 11 Jan 2018. In this case, do I need to mention all his absences from his first entry (in 2015) or on/after 11 Jan 2018.

Thanks in advance.

1. Yes is the answer for dependent.

2. Yes you need to post absences for the dependent only for the period after 11 January 2018.

Family Consent Form

Post by moumita28 » Wed Jan 01, 2020 9:49 pm

Hi
I have a confusion regarding signing the consent forms

I am main applicant and my husband is dependent applicant. I am currently under Tier 2 General Sponsorship Visa.

Me and My husband has Join account in Bank also we both have our names in all Utility Bills.

I am sure we need to sign Part 1 and 2 of the consent form.
https://visas-immigration.service.gov.u ... onsent.pdf

But I am confused about
PART 3: Consent for the Home Office to verify information from third party sponsor

My husband is working and he is paying our mortgage and some of the utility bills from his earning.
Does that mean he should sign the Part 3. Or am I completely misunderstanding the Part 3. Is it my sponsor i.e. my company sign the Part 3.

Also in that case what would be the answer of following question asked in the application.

Does the account with the bank or utility company for which you have supplied information and supporting documentation relate to another person who is to provide you financial support?

Please help me on this.

Thanks in advance.

Your husband need to sign part 3. That's my understanding from reading that consent form.
My advice is based on personal research/experience, so pls check relevant UKVI sources.

Your husband is not a third party, he is your husband. Did you take financial support from any third party aside your husband. If no then forget the form 3, it’s not needed. Sing the forms 1 and 2 and that should be fine.

The second question is still the same, it’s provided by your husband and he is a second party not third.

ILR Application Set (o)

Post by moumita28 » Mon Jan 13, 2020 2:26 pm

Hi
I am on Tier 2 Sponsorship Visa applying for ILR on 5 years basis.

I have filled up my SET(O) form but nowhere it asked me to fill 5 Years addresses. I am a bit worried if I am filling wrong form or missed anything.

Can anyone clarify please, if I need to enter my 5 Years address details some where in the form or am I in the right form.

Thanks in advance
