Divorce initiated during citizenships process

Post by Vick_tan » Thu Mar 05, 2020 12:20 pm

Hi
I m new to this forum , I am non eea spouse of eea National . I have applied for citizenship 2 months ago and received today divorce Petition from my eea wife Now there’s a confusion in my mind which is :
Married from 2012 with eea National
2016 our relationship broken and we separated but living in same house bills etc were on both of our names
2018 applied PR and mentioned married as we were and living in same house
2019 I moved out and now applied for citizenship
She mentioned in divorce petition that we were separated from 2016 , she said as we were separated however living in same house not a problem I told her why u not put last year date when I moved out in divorce petition.
Is this not Create problem for divorce that separate but living in same house
If HO come to know this will I have problem with my citizenship or losing PR ? Please advice she messed everything for me

If you are applying for citizenship based on 5 years residence, your divorce from an EU (non British) citizen is irrelevant!!

You are actually married until the divorce proceedings have been finalised, irrespective of what living arrangements you have agreed. "Separation" is not a status in law, it's just an arrangement, you are still married.
This is just my opinion as a member of this forum and does not constitute immigration advice.

Thanks again , do u think HO can’t create trouble for me if they find out separation date in divorce petition is the date when they were living in same house but didn’t mentioned in PR form they are separate but living in same house and revoked my PR or citizenship in future ?
Please advice

Actually, "separated" is a status in English marital law, but it needs the involvement of the courts. Most people divorce rather than going through a stage of being separated in law.
