Tier-2 dependent visa for UK born baby

Hi,

I’m holding Tier-2 general visa and I will be applying for Tier-2 extension in January-2021. I will be eligible for ILR in March-2021 after getting my visa extension. My baby born in Dec-2019 in the UK. I have no intention to travel to my home country until i get ILR next year. Do I need to apply Tier-2 dependent visa for my baby now before i apply visa extension? And then apply for Tier-2 extension for my baby along with my visa extension application in Jan-21?

Please advise.

You do not need a visa for your baby unless you want to travel and come back. But your baby will be eligible for NHS treatment for only 3 months after birth. So after 3 months you either get a visa or pay for treatment if anything happens (hope not).

Your child is covered until 3 months of age, but only if they didn't leave the UK during that period.

You'll also need to meet one of the below criteria:

you have a valid visa of more than 6 months and paid the surcharge for that visa
you have a valid visa for more than 6 months, but were exempt from paying the surcharge
you have a valid visa for more than 6 months, which you applied for prior to April 6 2015
You should apply for a visa for your child during the 3-month period after your child's birth.

If required, you may have to pay the surcharge for your child. Failure to do so means you may be charged for NHS services provided for your child after the 3-month period.

Thanks Chaplin for the details.

I'm working for NHS and as per the recent announcement,

"From 4 August 2020, workers eligible for the new Health and Care visa (Tier 2 General) and their dependants will not have to pay the IHS.".

Under this circumstance, can you please clarify whether i can use NHS service without applying dependant visa for my baby (more than 3 months old)?

You don't qualify for the free NHS extension. It is only those on the eligible list, i.e medical/clinical jobs.

Eligible professions
Your visa will be extended if you’re a:

biochemist
biological scientist
dental practitioner
health professional
medical practitioner
medical radiographer
midwife
nurse
occupational therapist
ophthalmologist
paramedic
pharmacist
physiotherapist
podiatrist
psychologist
social worker
speech and language therapist
therapy professional

Check with your employer if you’re not sure whether you work in an eligible profession.
