APPLYING FOR ILR

Post by Jack2013 » Thu Dec 12, 2019 9:59 am

Dear Members,
I am here since 2009. I was in Tier4 from 2009 to 2015. After my graduation I apply for Tier2 late 2015 and I kept waiting for my decision until 2017 March. Home office refuse my application in 2017 March and gave me a right to AR within 14 days. I submitted my AR within given date, and they wrote me back that your AR decision will be give within 28 days. While my Admin review was pending, I found new Tier2 sponsor and made fresh application. After my application home office wrote me back that while we had your new application, we are withdrawing your AR. My fresh application had been granted.
My question is as I am here is already 10 years and can I apply ILR? But according to section 3C, if you apply fresh application while your AR is pending, your section 3C is not continue. I am bit confuse.
can you help me.
Regards.

You overstayed between the date of the new application when AR was withdrawn (as your section 3C ended) and grant of the Tier 2 leave . However that period of overstaying will be ignored under paragraph 39E when you apply for ILR

My ILR

Post by Jack2013 » Sun Aug 02, 2020 10:52 am

Dear all,
I came to London in 2010 in T4 dependent visa and I change my visa in T2 as main applicant in 2015.
I did my first renewal my visa in 2019, MY daughter was born in Nepal and in 2015 I sponsored my daughter and visa has been granted as my dependent. We all renewal our visa in 2019 and it had been granted until 2021, My question is as 10 years long continues resident I am applying my ILR this month. Hence my daughter is in my dependent and her visa until 2021. Do I need to submit my daughter application at same time or I can do later?

thanks

She can't apply with you. Ilr based on long residence does NOT allow dependents.

She would qualify for ilr with you if you applied based on 5 years tier 2.

Why are you not applying for ILR under the Tier 2 route?

What is the UK immigration status of the other parent of the child?
