ILR application- confusion for child

Post by newbie715 » Sat Sep 26, 2020 11:22 am

Hi All, I'd appreciate any advice I can get on my situation. I am currently on FLR(M), got my first spouse visa in 2015. While I was visiting the States in 2018, I had my baby earlier than planned there. Due to my husband being British by Descent and some other limitations, she didn't qualify to get a passport and registering her as a British Citizen would have been at discretion, so she came in as an American with a 6 month stamp on her passport and we ended up getting her the same visa I have (FLR (M)). Now my confusion is this, I qualify in October to apply for ILR but her FLR (M) isn't due to be renewed till April 2021 and I am not sure what my options are...
- Do I add her to my ILR application even as her FLR(M) is still valid.
- Do I apply on my own and apply separately for her in April.
Thanks in anticipation.

Yes. There is no minimum 5 years residence requirement for small children.
- Do I apply on my own and apply separately for her in April.
No.
