ILR for Mom and Son together

Post by samuk2021 » Fri Oct 16, 2020 8:06 pm

Dear all
Thanks for reading my message. I am relatively new to this forum.
I am in ILR already for the last 3 years. Now I have to apply for my wife and Son together.
Its been some years for me as I am not in touch with new rules etc

both my wife and son qualifies for ILR via Tier -1 dependent route ( stayed 5 years)
My queries are:

1. I was told that I should apply only one application for my wife as well as for my son, and NO two separate applications required. - Is it true? If so, how should I apply for both of them in single application? Great if you could share any application link etc

2. What is the formal procedure to apply ILR via the normal postal service? Is there a step by step guidance document etc? ( eg: first apply , then where to give bio metric , photos etc?)

3. Do I need to apply via postal service only or is there any other fast speedy process available now ( like same day service - reopening etc)

4. What documents are required while applying online ? Do I need to scan the documents and upload ?

5. Lastly , how long it takes to receive the decision and BPR now days ( amidst COVID situation)

Is it better to apply online now or to wait for the same day service to open and then apply ?

I am really thankful for your replies.

Sam

Given you got your ILR via Tier 1 G route, your dependents will apply ILR on SET(O).

1) Yes. You can add family members in the same account online.

2) Apply online. Scan and upload documents via UKVCAS and attend biometrics appointment.

3) Apply online. For now only standard route. Super-priority is suspended.

4) The checklist will tell you about the documents and refer to guidance:
Your partner and any 18+ child will need to pass LIUK and English Test. Your partner will also need to prove cohabitation documents for last 2 years and any child 16+ will need some extra documents as per the guidance below. Absence limits apply for any leave granted after 11th Jan 2018.

https://assets.publishing.service.gov.u ... gov-uk.pdf

5) For now you can only apply for them as standard route. Follow the timeline thread for an idea. No one knows when Super-priority will resume.

You need documents in both names either jointly or addressed to each spouse, covering the last two years, from 3 to 6 different sources, spread evenly for every 3 to 4 months. This is to prove subsisting relationship.

thanks a lot

2 years cohabitation evidence!!
Hi there,
Hope you are doing fine and I am really sorry to disturb again.
When I tried to apply online ILR application form for my wife and Son .. got confused really.. thats why asking this message again.

Question is whether to use ILR Set (o) form or any other family route form like ILR Set (M) etc?

Bit of background:

I was in Tier1 General since 2012 and got my ILR got stamped on Sepetember 2017. Since then I am in ILR and only currently I am applying naturalisation etc

My wife and son Joined me as Tier 1 G - PBS dependents in May 2015 and they got their visa extended in March 2018 ( valid till June 2021). They applied their extension in 2018 based on previous PBS route and not based on my ILR.
Now as they completed 5 years in this may 2020.. applying ILR..

could you please confirm if I need to apply still in ILR (Set O ) route or should use other forms please ?

many thanks
Sam

Dear all ,
When I was trying to fill the application ILR form, below was one of the questions, which i actually dont understand .

Does the period of stay on which this application was based include any leave granted since 11 January 2018?

Have you had any absences from the UK during any leave granted since 11 January 2018?
(Required)
This includes all absences however short. Do not include travel to Crown Dependencies.

Could you please help me with this ? Do I need to provide all the travel details outside UK from 11 Jan 2018 to till date ?

I really appreciate your timely help
thanks
Sam

You will say yes and list any absences from UK only after March 2018 in your dependents case.

Do I need to provide the absence for the following next question too ?

Have you previously lived in a country outside the UK including your country of birth?

so this means .. complete absence list for the last 5 years from UK ?

Answer as the question asks. “LIVING” & “OUTSIDE UK” including country of birth from DOB.
Living is like for work, study, permanent living etc

Sorry to ask again..
so I have to answer yes and list the absence since birth.
for example: since DOB till she entered UK .. like 23 years and then the short absences which I provided in the previous questions ?

I know I am kind of annoying but really I dont understand .. thats why dear .. please

thanks a lot

You have to list any countries Ms X lived. Only outside UK. It is not asking for absences.

If you travel somewhere while you were based in UK, its not living.
