Post by Samy » Wed Sep 10, 2008 11:29 pm

I am basically from an Indian company. Currently working in the same company but in UK, with UK salary and Basic Salary in India.
I showing 2 months(Aug - Sep 2007) Indian Salary and remaining 10 months(Oct 07 - Jul 2008) in UK. I was a paid a Bonus amount in India in March 2008.
Can I show the salary in this form?

Aug 2007 to Sep 2007: You were working IN India, so use uplift of 5.3
IND Gross Sal * Exch Rate * 5.3 = X
Oct 2007 to Jul 2008: You were working in UK, DONT use uplift (even for Indian Salary)
UK Gross Sal + (India Gross incl Bonus * Exch Rate) = B

Prev Earnings total is A + B

Hope this clarifies. There is a minor update to policy guidance on Sep 11th 2008. Pls get the latest and read thoroughly. Use online points calculator from UKBA to get an idea on points.

Just saw the link Sushdmehta had given. That answers your question too.
Best regards,
Mani

Hi all,

I think I goofed up in my application.
I have claimed my previous earnings as earned in India and uplifted them by 5.3
I was in the UK for 6 weeks in this period.
After reading these posts I assume that I was wrong uplifting the earnings of those 2 months when I was in the UK.
Gurus- How would this be treated by the CW's?
1. I haven't claimed any points for UK Earnings.
2. I had been paid allowances in cash and TC's while in UK (Hence nothing in the Bank statements)
3. I have mentioned that I hold a prior visa (WP), and I was in the UK for 6 weeks.
4. Also, If I just consider earnings of 10months uplifted(ignoring completely the earnings during those 6 weeks), I still fall in the band for same points..

I am still awaiting any response on my Appl.

That should be fine Anubhav78

They may either remove the months in question from calculations OR they may calculate without uplift. Since you say that you have same points either case, it should be fine and you may get approval. Hope for good. Best wishes!

Worst case scenario - a CW can treat this as applying with frauulent information / deception.

Though an old HSMP EC case (not Tier 1) but reading this would help you understand the possible (worst) outcome. The applicant, in this case, applied for review with justifications as suggested by others (read thread) but AFAIK the decision wasn't changed.

Not in anyway suggesting that this is bound to happen to you, but just making you aware of a (real) possibility.

Why not withdraw and apply again with accurate calculations?

Circmstances haven't changed. Have they??

It was error in interpretation and accurate application of rules. Points-based calculator helps you in avoiding such mistakes - should one care to use it before submitting an application.

Yes, no change in circumstances. I am not sure, I can't think of how to react.

Thanks a lot for that link, it alerts me to provide all information in the covering letter. I did travel to India and worked from on company's request there for 2 months. However, I am not claiming uplift for this period since no change in my salary; it was same in US & in India. However, I am going to mention this in the covering letter as went to India for US visa stamping. My US visa stamping did get delayed (like 1 month delay). Please suggest if I am doing any thing wrong here.

There is a section in the application asks about your 10 year travel history.
