Gap issue : Renewed Visa in Home Country


Application Refused!

Reason: Applied Visa at home country

“ applied for an entry clearance as a student in your home country, which was granted on 26 July 2006, this broke continuity of your residence in UK, therefore it has been decided that you have not had at least 10 years continuous lawful residence in the UKâ€

How do you cope with sentence from Home Office as a fact that I did have a entry clearence from my home country?

“a person who leaves the UK when one period of leave expires, and comes back with a fresh grant of leave, will not be resuming his continuous residence, but will instead be starting a NEW PERIOD of resident in the UK â€

The case "TT" states it is acceptable to leave the country to apply for another visa AS LONG AS THE ORIGINAL VISA END DATE DOES NOT EXPIRE BEFORE YOU RETURN ON THE NEW VISA.

You go back to UKBA and point them to TT and say sort it out.

How are you doing timewise with the expiry of your current visa? If you have many months left, you can print the information about TT and ask for a reconsideration (it was the caseworker's error, he should know about TT).
