Tier 2 ICT > Skilled Worker (different employer)

Post by akw2106 » Sun Dec 27, 2020 11:47 pm

I am currently on a Tier 2 ICT visa (issued Dec 2020), however, have been offered a new job at a different employer.

I am really interested in taking the new job but was wondering whether it is actually possible to swap from an ICT Visa to a Skilled Worker Visa in country without having a significant amount of time off work (looks like current Tier 2 wait times are 8ish weeks).

Any advice on whether this is actually possible would be greatly appreciated!!

Note: I am also eligible for a Tier 5 Youth Mobility as I am an Australian citizen and under 30 but have been told it is not possible to apply for this out of country (can’t get back at the moment due to Covid). If this is not the case would also be great to know! :)

Yes, you can switch to SW visa. https://www.gov.uk/skilled-worker-visa/ ... -this-visa

Not sure why you need time off.. you need to apply and wait until you get the approval and then resign from your current job. Depending on the notice period there may be a bit of planning to do to keep the gap minimum, but you could start the new job on a date by negotiating/changing the start date with your new employer.

I'm not sure about YMS visa, so wait for other members input.
My advice is based on personal research/experience, so pls check relevant UKVI sources.

You cannot apply for tier 5 YMS within the UK. You would need to apply from your home country.

The concept of ICT and what the visa conditions are have been essentially outmoded by the Skilled Worker route. With the ability to switch to the Skilled Worker route you can move employer readily and have a greater scope of employment in the UK.

The period of notice and starting the new role are outside the remit of UKVI, how you achieve the cross over is your concern. Points to remember.
Suggest you do not resign before you receive new visa.
I would suggest you do not leave the UK while your visa application is being decided. If your current employer discovered your intention and cancel your visa you will not be able to return and your application will become void.
